IACHR Publishes Friendly Settlement Report on Case Concerning Ronald Jared Martínez Velásquez and Others in Honduras

Washington, D.C. – The Inter-American Commission on Human Rights (IACHR) plans to approve and publish friendly settlement report 269/21, concerning Case 12,960—Ronald Jared Martínez Velásquez and Others, Honduras. This agreement was signed on September 22, 2020 by the Honduran State and representatives of the victims and their families.

This case concerns the international responsibility of the State of Honduras for alleged violations of the rights to personal integrity and to judicial protection and guarantees, and of the rights of the child, affecting Ronald Jared Martínez Velásquez and Marlón Fabricio Hernández Fúnez. Martínez Velásquez and Hernández Fúnez were injured and left with temporary and permanent physical disabilities as a result of the disproportionate use of force by police officers and by personnel of the National Army in a road traffic operation.

In Article 6 of the friendly settlement agreement that was signed by the parties, the Honduran State committed to granting financial reparations to the beneficiaries, Ronald Jared Martínez Velásquez, José Roberto Martínez, and Marlon Fabricio Hernández Fúnez. In friendly settlement report 269/21, the Commission noted full compliance with this article and considered that full compliance had been attained regarding the agreement as a whole. The IACHR therefore stopped monitoring the case, which it considers closed.

The Commission commends the Honduran State on its efforts to build a public policy concerning friendly settlements and alternative conflict-resolution. The IACHR invites the State to continue to use the friendly settlement mechanism to resolve other cases that are currently being addressed in the individual petition and case system. The Commission congratulates the petitioning party for all its efforts to take part in negotiations and to seek implementation of this agreement.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for and to defend human rights in the region and acts as a consultative body to the OAS in this area. The Commission is composed of seven independent members who are elected in an individual capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
