Mandate

The DESCA Special Rapporteur is responsible for supporting the IACHR in fulfilling its mandate to promote and protect economic, social, and cultural rights in the Americas.

Principal functions

  • Prepare the work plan of the DESCA Special Rapporteur, following the IACHR's strategic plan.
  • Prepare reports on ESCER for the consideration of the IACHR and publication, including thematic reports, on the general human rights situation of the member states, and sections of the annual report of the Commission.
  • Work with individual cases on DESCA for the decision of the IACHR, as well as represent, by delegation, the Commission in litigation before the Inter-American Court of Human Rights, in cases related to DESCA.
  • Make recommendations to the IACHR on urgent situations that could require the adoption of precautionary measures or the request for the adoption of provisional measures before the Inter-American Court of Human Rights, among other mechanisms.
  • Monitor the situation of ESCERs in the region and provide advice and assistance to the OAS Member States in the adoption of legislative, judicial, administrative, or other measures that are necessary to make effective the exercise of economic, social, and economic rights. cultural.
  • Advice and assist other organs of the Organization of American States (OAS) in matters related to ESCR in the Americas.
  • Develop the necessary steps for the collection and management of cooperation funds and for the development of the projects required to fulfill the assigned mandate.
  • Fulfill other mandates related to the promotion and protection of ESCR that are delegated to it by the IACHR by its mandate.
  • Assist the IACHR in promoting international instruments related to economic, social, and cultural rights, including organizing and participating in promotional activities directed at authorities, professionals, and students about the work of the IACHR in this area.
  • Make recommendations to the IACHR on urgent situations that may require the adoption of precautionary measures or the request for the adoption of provisional measures before the Inter-American Court of Human Rights, among other mechanisms.
  • Monitor the situation of ESCERs in the region and provide advice and assistance to the Member States of the Organization of American States (OAS) in the adoption of judicial, administrative, or other legislative measures that are necessary to make the exercise effective. of economic, social, cultural, and environmental rights.
  • Advice and assist other OAS bodies in matters related to ESCER in the Americas.
  • Develop the necessary steps for the collection and management of cooperation funds and for the development of the projects required to fulfill the assigned mandate.
  • Carry out other tasks related to the promotion and protection of the DESCA that are delegated to it by the IACHR by the mandate of the DESCA Special Rapporteur. Thus, REDESCA was delegated by the IACHR to join the OAS Working Group on Economic, Social, and Cultural Rights, on its behalf.
