EXPLANATORY NOTE
Pursuant to the provisions of Article 46 of the Rules of Procedures of the Second Inter-American Specialized Conference on Terrorism, held in Mar del Plata, Argentina, on November 23-24, 1998, the General Secretariat herewith publishes the Final Report in the four official languages of the Organization.In due course, the General Secretariat will publish the Proceedings and Documents of the Conference.
FINAL REPORT OF THE SECOND INTER-AMERICAN
SPECIALIZED CONFERENCE ON TERRORISM
I. INTRODUCTION
1. Background
The Second Inter-American Specialized Conference on Terrorism originated in the Plan of Action of the Second Summit of the Americas (Santiago, Chile, April 1998), at which the heads of state and government expressed their willingness to take measures "as agreed in the Declaration and Plan of Action of Lima, in order to prevent, combat, and eliminate terrorism, applying for that purpose the most decisive will to comply with the general objectives set forth therein" and to convene "under the auspices of the Organization of American States (OAS), the Second Specialized Inter-American Conference to evaluate the progress attained and to define future courses of action for the prevention, combat, and elimination of terrorism."
Pursuant to that mandate, the General Assembly, at its twenty-eighth regular session (Caracas, June 1998), through resolution AG/RES. 1553 (XXVIII-O/98), instructed the Permanent Council to carry out the preparatory work for the Second Inter-American Specialized Conference on Terrorism, with a view to convening it.
At the meeting of the Permanent Council on June 28, 1998, the Permanent Mission of Argentina to the OAS formally submitted its Government's offer to host the Second Inter-American Specialized Conference on Terrorism.
The Permanent Council, through resolution CP/RES. 725 (1165/98) of August 5, 1998, accepted Argentina's offer to host the Conference. At its meeting of August 19, 1998, it transmitted that topic to the Committee on Juridical and Political Affairs for consideration. That Committee, at its meeting of September 10, considered and approved the proposal of the delegation of Argentina to set November 23 and 24, 1998, as the dates for the meeting and to hold it in Mar del Plata, Argentina.
For its part, the Committee, at its meeting held on August 27, 1998, set up the Working Group on Terrorism, which undertook the preparatory work for the Conference, including preparation of the draft Agenda, Schedule, and Rules of Procedure, under the chairmanship of Ambassador Julio C�sar Ar�oz, Permanent Representative of the Argentine Republic to the Organization, and the vice chairmanship of Ambassador Victor Marrero, Permanent Representative of the United States to the Organization.
The Working Group had three formal and one informal meeting, at which it reviewed organizational aspects of the Meeting of Experts to Prepare for the Second Inter-American Specialized Conference on Terrorism and drew up a preliminary draft Commitment of Mar del Plata, which was considered by the above-mentioned Meeting of Experts, held on October 15 and 16, 1998 at OAS headquarters.
The opening session of the Meeting of Experts to Prepare for the Second Inter-American Specialized Conference on Terrorism took place in the Hall of the Americas on October 15, 1998, at 9:30 a.m. On that occasion, speeches were delivered by Ambassador Julio C�sar Ara�z, Chair of the Working Group on Terrorism, and Dr. Carlos Corach, Minister of the Interior of the Republic of Argentina.
Immediately thereafter, the Meeting proceeded to elect its officers. Ambassador Christopher W.S. Ross, Head of the United States Delegation, and Dr. Jos� Mar�a Vernet, of the Argentine Delegation, were elected by acclamation Chair and Vice Chair, respectively.
During the two days that the Meeting lasted, there were four working sessions, two on October 15, and two the following day. At the first of these, the Chair made a presentation on progress made with the Plan of Action of Lima and took note of the observations made by the delegations. The preliminary draft agenda and schedule for the Second Inter-American Specialized Conference on Terrorism were also reviewed and approved.
In subsequent sessions, the Meeting of Experts considered the preliminary daft Commitment of Mar del Plata and other preliminary documents that were presented to the plenary
of the Second Inter-American Specialized Conference on Terrorism.The Meeting of Experts achieved some major advances in discussion of the Commitment. In that connection, at its meeting on October 22, 1998, the Committee on Juridical and Political Affairs, approved the request by the Chair of the Working Group on Terrorism to hold informal meetings in order to finish work on the drafting of the preliminary draft Commitment of Mar del Plata, as well as a formal meeting once the work had been completed. That meeting took place on November 11, 1998 and approved the aforementioned preliminary draft.
Subsequently, the Permanent Council took note of the Schedule and approved the draft Agenda and Rules of Procedure for the Conference.
2. Conference Secretariat
The General Secretariat was represented by Mr. C�sar Gaviria, Secretary General of the OAS, and Mr. Enrique Lagos, Assistant Secretary for Legal Affairs of the OAS.
II. PROCEEDINGS
1. Opening session
The opening session of the Conference was held on November 23, 1998, at 9:30 a.m., at the Hotel Costa Galana in Mar del Plata, Argentine Republic. The session was chaired by Ambassador Julio C�sar Ar�oz, Permanent Representative of the Argentine Republic to the OAS. Statements were delivered by the Secretary General of the OAS, C�sar Gaviria, and the Minister of Interior of the Argentine Republic, Dr. Carlos Corach.
In keeping with Article 17 of the Rules of Procedure of the Conference, the heads of delegation adopted agreements on the following aspects: adoption of the Agenda, election of the Chair and Vice Chair of the Conference, adoption of the Rules of Procedure, and agreement on the Committee on Credentials.
2. Chair and Vice Chair of the Conference
The Minister of the Interior, Dr. Carlos Corach, was elected Chair by acclamation, at the proposal of the delegation of Brazil, on behalf of the MERCOSUR countries and Chile and Bolivia. His nomination was seconded by the delegation of Peru.
Ambassador Christopher Ross, head of the delegation of the United States, was elected Vice Chair of the Conference by acclamation, at the proposal of the delegation of Venezuela, which was seconded by the delegation of Canada.
The order of precedence of the delegations to the Conference had been established by the Permanent Council at its meeting of November 16, 1998 (CEITE-II/doc.4/98 corr. 1).
3. Agenda
The Conference adopted the following agenda, set forth in document CEITE-II/doc.2/98 rev. 1, as presented:

a. National measures to prevent, combat, and eliminate terrorist acts:
i. Definition of terrorist acts as serious common crimes
ii. Adoption of antiterrorist legislation consistent with the protection of human rights and civil liberties
iii. Universal accession to international conventions on terrorism
iv. Effective border security measures (travel documents; aviation, airport, and other point of entry/exit security procedures)b. Bilateral cooperation measures to prevent, combat, and eliminate terrorism
c. Multilateral cooperation measures to prevent, combat, and eliminate terrorism:
i. Exchange of information (effective antiterrorist policies, ways to counter fundraising by terrorist groups, etc.)
ii. Judicial cooperation (joint investigations, exchange of experts and evidence, extradition)
iii. Regular and technical training for personnel responsible for combating terrorism
iv. Cooperation in preparing contingency plans for crisis management in cases related to terrorism
v. Ways to prevent the use of diplomatic privileges in promoting terrorism
vi. Ways to improve security for diplomatic staff and installations against terrorist acts
vii. Ways to combat the mounting danger of nuclear, chemical, and biological terrorism and to prevent terrorist groups from gaining access to any other kinds of armaments
viii. Ways to prevent production of and illicit trafficking in firearms, ammunition, and explosives
ix. Methods to address technological innovations in the evolving threat of cyberterrorism
x. Consideration of the Report of the Inter-American Juridical Committee5. 4. Rules of Procedure
The Conference adopted the Draft Rules of Procedure contained in document CEITE-II/doc.7/98, as presented.
5. Establishment of the Committee on Credentials
In keeping with Article 39 of the Rules of Procedure, at the opening session the Conference decided to establish the Committee on Credentials, which was composed of the delegations of Brazil, Chile, and Guatemala.
6. Plenary Sessions
The Conference held four plenary sessions, during which the heads of delegation made general statements on national measures and bilateral and multilateral cooperation initiatives to prevent, combat, and eliminate terrorism. The Commitment of Mar del Plata, set forth in section III of this report, was adopted, as amended. In addition, three resolutions were approved, which also appear in section III.
The report of the Committee on Credentials was also considered.
7. Closing Session
The Second Inter-American Specialized Conference on Terrorism was declared closed, on November 24, 1998, at 5:30 p.m., by Dr. Carlos Sa�l Menem, President of the Argentine Republic, who addressed the Delegations participating and emphasized the importance of the Commitment of Mar del Plata adopted at the Conference.
